References to “us,” “we,” or “Language Monkey Bar” pertain to the owner of the app, while “you” refers to the user or viewer of our app. If you are using Language Monkey Bar on behalf of an organization, such as your employer, you are agreeing to these terms on behalf of that organization and confirming that you have the authority to bind the organization to these terms. In such cases, “you” and “your” will refer to the organization.
Please carefully read these Terms of Service (“Terms”) and our Privacy Policy before using Language Monkey Bar. We may periodically revise these Terms, and any changes will be posted within our app. Therefore, we encourage you to check the app regularly for updates. The most current version of the Terms will always be available on our dedicated Terms page. By continuing to use Language Monkey Bar after the revised Terms take effect, you agree to be bound by the updated Terms. If you do not agree with the new Terms, please discontinue using Language Monkey Bar.
Language Monkey Bar is a security application designed to protect your personal photos, videos, and chats. However, we do not guarantee 100% security. All information in the app is backed up on an encrypted cloud.
AUTO-RENEWING SUBSCRIPTIONS
For auto-renewing subscriptions completed in our iOS apps, the following terms apply:
- Payment will be charged to your iTunes Account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
- You can manage your subscriptions and turn off auto-renewal by accessing your Account Settings in the app after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
- You can cancel a free trial or subscription at any time by turning off auto-renewal through your iTunes account settings. This must be done 24 hours before the end of a free trial or subscription period to avoid being charged. The cancellation will take effect the day after the last day of the current subscription period, and you will be downgraded to the free service.
YOUR INFORMATION AND RESPONSIBILITIES
You may only use Language Monkey Bar if you are 13 years or older and not prohibited by applicable law from using the app.
You must not use Language Monkey Bar for any illegal or unauthorized purposes.
You must not access Language Monkey Bar using automated or non-human means, including bots, scripts, or any other method.
LANGUAGE MONKEY BAR INTELLECTUAL PROPERTY RIGHTS
Language Monkey Bar and its licensors exclusively own all associated intellectual property rights, including copyright and trademarks, related to Language Monkey Bar. You acknowledge that Language Monkey Bar is protected by copyright and trademark laws. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights or notices incorporated in or accompanying Language Monkey Bar.
Language Monkey Bar grants you a limited, non-exclusive, non-transferable license to view, copy, and display Language Monkey Bar solely for your permitted use of the app.
GENERAL PROHIBITIONS
You agree not to do or attempt any of the following:
- Decipher, decompile, disassemble, or reverse engineer any software used to provide Language Monkey Bar.
- Introduce malware or use Language Monkey Bar to distribute malware.
- Violate any applicable laws or regulations.
- Encourage or enable others to engage in any of the above activities.
While we are not obligated to monitor access to or use of Language Monkey Bar or your content or review or edit any of your content or the intellectual property of other Language Monkey Bar users, we reserve the right to do so. We may monitor and review content to ensure compliance with these Terms, applicable laws, or other legal requirements. We also reserve the right, at our sole discretion and without notice, to remove or disable access to any of your content if we consider it objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or any conduct that affects Language Monkey Bar. We may consult and cooperate with law enforcement authorities to prosecute users who violate the law.
TERMINATION
We may suspend or terminate Language Monkey Bar or your access to and use of Language Monkey Bar at any time and without notice, at our sole discretion. For example, we may suspend or terminate your use if you fail to comply with these Terms or use Language Monkey Bar in a way that may causeharm to us or others. Upon termination, your right to use Language Monkey Bar will immediately cease, and we may permanently delete your account and all associated data.
DISCLAIMER OF WARRANTIES
LANGUAGE MONKEY BAR IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LANGUAGE MONKEY BAR WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF LANGUAGE MONKEY BAR IS AT YOUR OWN RISK.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LANGUAGE MONKEY BAR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF LANGUAGE MONKEY BAR, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEMNIFICATION
You agree to indemnify and hold Language Monkey Bar, its affiliates, directors, employees, agents, suppliers, and licensors harmless from any claims, losses, damages, liabilities, including attorney’s fees, arising out of your use or misuse of Language Monkey Bar, your violation of these Terms, or your violation of any rights of a third party.
GOVERNING LAW AND JURISDICTION
These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Language Monkey Bar is incorporated, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or Language Monkey Bar will be subject to the exclusive jurisdiction of the courts located in the jurisdiction in which Language Monkey Bar is incorporated.
SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the remaining provisions and will not affect their validity and enforceability.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Language Monkey Bar regarding the use of Language Monkey Bar and supersede any prior or contemporaneous agreements, understandings, or arrangements between us, whether oral or written.
